Kitchen Storage Makeover Contest Rules

NO PURCHASE IS NECESSARY TO ENTER OR WIN. A PURCHASE WILL NOT INCREASE YOUR CHANCES OF WINNING. ALL FEDERAL, STATE, LOCAL, AND MUNICIPAL LAWS AND REGULATIONS APPLY. VOID WHERE PROHIBITED.

1.Eligibility

The Contest subject to the rules and described herein is open to legal residents of the continental United States and the District of Columbia who are at least eighteen (18) years old at the time of entry. Employees of Foodservice Equipment & Supplies, InterMetro Industries Corporation and other companies associated with the promotion of the Contest, and their respective parents, subsidiaries, affiliates and advertising and promotion agencies as well as the immediate family (spouse, parents, siblings, and children) and household members of each such employee are not eligible. The Contest is subject to federal, state, and local laws and regulations.

2. Host and Sponsor

The Contest is hosted by Zoomba Group, LLC d/b/a Foodservice Equipment & Supplies (“Host”), located at 190 North York Street, Elmhurst, Illinois 60126. The Contest Sponsor is InterMetro Industries Corporation (“Sponsor”), located at 651 North Washington Street, Wilkes-Barre, PA 18705.

3. Agreement to Official Rules

Participation in the Contest constitutes entrant's full and unconditional agreement to and acceptance of these Official Rules and the decisions of the Host, which are final and binding. Winning a prize is contingent upon being compliant with these Official Rules and fulfilling all other requirements set forth herein.

4. Contest Period

The Contest begins on November 1, 2023 at 8:00 AM Central and ends on February 29, 2024 at 11:59 PM Central (the "Contest Period"). Entries that are submitted before or after the Contest Period will be disqualified. Submissions will be accepted for the duration of the Contest through the method set forth in paragraph 5.

5. How to Enter

The sole method of entry will be available by visiting our website (www.fesmag.com/ksm) and following the directions for online entry by filling out the entry information and submitting such entry. Limit one (1) entry per person per foodservice operation (foodservice operation includes, but is not limited to, commercial restaurants and non-commercial foodservice operations such as hospitals, college & university foodservice, K-12, military, etc.) or foodservice equipment dealer or consultant (foodservice equipment dealer or consultant refers to anyone who recommends or sells equipment or supplies to foodservice operations) for the duration of the Contest Period. All entries become the joint property of Host and Sponsor and will not be acknowledged or returned.

6. Description of Contest

Entrants are to submit their entry via the website www.fesmag.com/ksm. Entries of the Contest must include the following to be considered valid:

  • Overview of Foodservice Operation: A 400-word maximum description of the foodservice operation being submitted, including size, menu, service type, target audience.
  • Description of Storage Needs: A 400-word maximum description of why the storage area is deemed to require a makeover and how the foodservice operation, its employees and/or customers will benefit.
  • Up to ten (10) pictures of the storage area in need of a makeover
  • Pertinent information to the foodservice operation, including name of operation, address, submitter’s name, email and phone number and type of foodservice operation.

7. Prize Drawing

During the week of March 11, 2024, the Host will assemble a panel of judges (“Judges”) to review all entries that have submitted the criteria set forth in paragraph 6. The Judges will select one winner. This winner will be the food service operation who best demonstrates through the criteria set forth in paragraph 6 that the storage makeover will have the greatest positive impact on its efficiency. The Judges’ decision will be final. An alternate winner will be selected in the event the winner cannot be contacted within five (5) days. The Host will notify the winner via telephone during the week of March 18, 2024 and will continue for five (5) days to contact such winner. If the winner cannot be contacted within five (5) days, the Host will select an alternate winner in his/her place as chosen by the Judges in the same manner as the original selection.

8. Winner Notification

The winner will be notified by phone. The winner will be required to complete, electronically sign and submit a Declaration of Compliance within five (5) days of the date notice or attempted notice is sent, in order to claim his/her prize. If a winner cannot be contacted, or fails to submit the Declaration of Compliance within the required time period (if applicable), winner forfeits prize. If the winner is at least 18 but still considered a minor in his/her jurisdiction of residence, Host reserves the right to award the prize in the name of his/her parent or legal guardian, who will be required to sign the Declaration of Compliance on the winner’s behalf and fulfill any other requirements imposed on winner set forth herein. Winners must continue to comply with all terms and conditions of these Official Rules, and winning is contingent upon fulfilling all requirements. In the event that a potential winner is disqualified for any reason, Host will award the applicable prize to an alternate winner as selected by the judges. Only three (3) alternate winners will be selected, after which the prize will remain un-awarded. Such prize will be redeemable by the winner for six weeks.

9.Prize

The Prize is a Kitchen Storage Makeover provided by InterMetro Industries Corporation (“Makeover”). The Makeover includes a consultation of the commercial kitchen storage needs plus storage products deemed necessary. Total value of product to be supplied is solely determined by the InterMetro Industries Corporation assessment of needs. Total value caps out at $50,000 list. Product is provided directly from InterMetro Industries Corporation and not processed through channels. InterMetro Industries Corporation will provide assembly and installation support through the preferred local dealer or other installer at InterMetro Industries Corporation’s digression. The Makeover cannot be turned in for any cash value. Entrants agree to schedule an InterMetro Industries Corporation productivity assessment within six weeks of their receipt of the prize. Entrants agree to allow assessment and Makeover to occur during normal business hours.

10. General Conditions

In the event that the operation, security, or administration of the Contest is impaired in any way for any reason, including, but not limited to fraud, virus, bug, worm, unauthorized human intervention or other technical problem, or in the event the Contest is unable to run as planned for any other reason, as determined by Host in its sole discretion, the Host may, in its sole discretion, either (a) suspend the Contest to address the impairment and then resume the Contest in a manner that best conforms to the spirit of these Official Rules or (b) terminate the Contest and, in the event of termination, complete the judging and selection of prize winner from among the eligible, non-suspect entries received up to the time of the impairment. The Host reserves the right in its sole discretion to disqualify any individual it finds to be tampering with the entry process or the operation of the Contest or to be acting in violation of these Official Rules or in an unsportsmanlike or disruptive manner. Any attempt by any person to damage the website or undermine the legitimate operation of the Contest may be a violation of criminal and civil law, and, should such an attempt be made, the Host reserves the right to seek damages (including attorney's fees) and any other remedies from any such person to the fullest extent permitted by law. Failure by the Host to enforce any provision of these Official Rules shall not constitute a waiver of that provision.

Entrants may be contacted by employees or agents of the Host and Sponsor or one of its dealers. Any inaccurate information, whether intentional or otherwise, as well as tampering with the contest may result in disqualification and subject the entrant to potential further legal action.

11. Release and Limitations of Liability

By participating in the Contest, entrants agree to release and hold harmless the Host and Sponsor, and each of their respective parents, subsidiaries, affiliates, advertising and promotion agencies, other companies associated with the Contest, and each of their respective officers, directors, employees, shareholders, representatives, and agents (the Released Parties) from and against any claim or cause of action arising out of participation in the Contest or receipt or use of the prize (including any travel or activity related thereto), including, but not limited to: (a) any technical errors associated with the Contest, including lost, interrupted or unavailable Internet Service Provider (ISP), network, server, wireless service provider, or other connections, availability or accessibility or miscommunications or failed computer, satellite, telephone, cellular tower or cable transmissions, lines, or technical failure or jumbled, scrambled, delayed, or misdirected transmissions or computer hardware or software malfunctions, failures or difficulties; (b) unauthorized human intervention in the Contest; (c) mechanical, network, electronic, computer, human, printing or typographical errors; (d) application downloads, (e) any other errors or problems in connection with the Contest, including, without limitation, errors that may occur in the administration of the Contest, the announcement of the winner, the cancellation or postponement of the event and/or the flyover, if applicable, the incorrect downloading of the application, the processing of entries application downloads or in any Contest-related materials; or (f) injury, death, losses or damages of any kind, to persons or property which may be caused, directly or indirectly, in whole or in part, from entrants participation in the Contest or acceptance, receipt or misuse of the prize (including any travel or activity related thereto). Entrant further agrees that in any cause of action, the Released Parties liability will be limited to the cost of entering and participating in the Contest, and in no event shall the entrant be entitled to receive attorney's fees. Released Parties are also not responsible for any incorrect or inaccurate information, whether caused by site users, tampering, hacking, or by any equipment or programming associated with or utilized in the Contest. Entrant waives the right to claim any damages whatsoever, including, but not limited to, punitive, consequential, direct, or indirect damages.

12. Disputes

Except where prohibited, each entrant agrees that any and all disputes, claims and causes of action arising out of, or connected with, the Contest or any prize awarded shall be resolved individually, without resort to any form of class action, and exclusively by a Court located I the state of Illinois, County of DuPage. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, entrants rights and obligations, or the rights and obligations of the Host and Sponsor in connection with the Contest, shall be governed by, and construed in accordance with, the laws of Illinois, without giving effect to any choice of law or conflict of law rules, which would cause the application of the laws of any jurisdiction other than Illinois.

13. Privacy

Information collected from entrants is subject to Host's privacy policy.

14. General Information

Host or Sponsor is not responsible for any incorrect or inaccurate entry information, human error, technical malfunctions, failures, omission, interruption, deletion, or defect of any telephone network, computer online systems, computer equipment, service providers, or software, including any injury or damage to participants or any other person's computer relating to or resulting from participation in this contest. Host is not responsible for any inability to access the websites, theft, tampering, deconstruction, or unauthorized access to, or alteration of entries, entries that are processed late, incorrectly or incomplete or lost due to computer electronic malfunction or traffic congestion on the internet or at any website. Finally, Host is not responsible for inaccuracies in printing, typographical errors, or human or other errors, any entries which are late, lost, incomplete, delayed, misdirected, stolen, mutilated, inaccurate, ineligible, or that arrive postage due, or any combination of the above.

By entering this contest, all contestants agree to the terms herein set out.
